Vehicle Tender

TERMS & CONDITIONS OF BIDDING AND PURCHASE
(Dealer-Only Wholesale)

By registering as a Buyer and submitting any bid in the AP Eagers / Eagers Automotive Vehicle Tender, the Buyer acknowledges that it is a licensed motor vehicle dealer and agrees to be bound by these Terms & Conditions. Participation is strictly limited to authorised dealers.

1. Buyer Declarations

  1. The Buyer warrants that all registration information is true and complete.
  2. The Buyer is a licensed motor vehicle dealer authorised to participate in dealer-only tenders.
  3. The Buyer has authority to act for any nominated entity.
  4. Each bid is an irrevocable offer to purchase under these Terms.

2. Vehicle Condition - AS IS / WHERE IS

  1. All vehicles are sold "AS IS, WHERE IS", with all faults.
  2. No warranty or guarantee is provided, including condition, roadworthiness, or mileage accuracy.
  3. Vehicles are sold unregistered unless stated otherwise.
  4. Reports or descriptions are guides only and not warranties.

3. Disclosure, Information & Inspection

  1. Vehicle information may not be independently verified.
  2. Listings may be amended or withdrawn prior to bidding.
  3. Buyers should conduct their own inspections and PPSR checks.
  4. Failure to inspect is at the Buyer's risk and no claims will be accepted.

4. Bidding & Tender Process

  1. All bids are final, binding, and irrevocable.
  2. Prices include GST unless stated otherwise.
  3. Highest bids are submitted for seller acceptance.
  4. AP Eagers may accept or reject bids, withdraw vehicles, re-tender, or negotiate with the highest bidder.

5. Collusion & Dealer Conduct

  1. No collusion, price fixing, or improper conduct.
  2. Suspected misconduct may result in cancellation or exclusion.
  3. All attendees must follow health and safety requirements.
  4. Abusive behaviour may result in suspension or exclusion.

6. Payment & Completion

  1. Full payment by EFT within 48 hours unless otherwise agreed.
  2. Title passes only after cleared funds are received.
  3. Late payment may result in cancellation and refusal of future bids.

7. Collection & Risk

  1. Risk passes at tender close.
  2. Vehicles must be collected within five business days or as specified.
  3. Storage and transport costs are the Buyer's responsibility.
  4. AP Eagers is not liable for loss or damage during removal except for negligence.

8. Fees

  1. $99 administration fee per vehicle (incl. GST).
  2. Additional fees will be disclosed where applicable.

9. Default & Termination

  1. For breach, deposits may be forfeited and vehicles resold.
  2. AP Eagers may terminate for convenience or suspected illegal conduct.
  3. Termination does not affect accrued obligations.

10. Liability & Limitation

  1. No liability for vehicle defects, inaccurate information, or consequential loss.
  2. Sales may be cancelled due to administrative error with full refund.

11. Privacy

  1. Information handled in accordance with the Privacy Act 1988 (Cth).
  2. May be disclosed to sellers or regulators where required.
  3. May be used for marketing unless opted out.
  4. Failure to provide required information may prevent participation.

12. General

  1. These Terms form the entire agreement.
  2. Indemnities survive termination.
  3. Terms may be amended with seven days' notice.
  4. Continued participation constitutes acceptance.
  5. Notices may be given by email, post, website, or on-site display.

13. Test Drives & Trade Plates

  1. Test drives are at AP Eagers' discretion and at the Buyer's risk.
  2. Buyers must supply their own valid trade plates.
  3. Drivers must hold a valid licence and comply with road laws.
  4. No smoking, racing, or excessive acceleration.
  5. Buyers are responsible for damage, fines, tolls, and costs.
  6. Maximum distance: 20 km unless approved.
  7. Insurance excess: $5,000.
  8. Vehicle must be returned immediately upon request.

Dealer-Only Vehicle Tender - Key Conditions

  • Participation limited to licensed dealers.
  • All bids submitted online and are final.
  • Viewing available Tuesdays 9:00am - 3:30pm.
  • Tender closes 5:00pm Tuesday.
  • Successful bidders notified same day.
  • Payment required within 48 hours.
  • Vehicles sold unregistered and AS IS, WHERE IS.
  • No returns, refunds, or claims.
  • Collection required by the following Monday unless agreed.
  • $99 administration fee per vehicle.
  • All inspections and verification are the Buyer's responsibility.
